2007 EAA’s Membership Promotion

Eligibility

The 2007 EAA Membership Promotion is conducted by Experimental Aircraft Association, Inc. (“EAA”) The Membership Promotion is open to US residents age 18 and over. Employees, directors, and officers of EAA and sponsors of the Member Promotion are ineligible, as are persons living in any of their respective households.

The Grand Prize Qualifier runs during the promotion period of 4/1/07 through midnight 3/31/08 (the “Promotion Period”). Each valid entry will receive an equal chance to win, regardless of how you enter.

Grand Prize Drawing: The Grand Prize Drawing will be held in April 2008. Each Grand Prize Qualifier entry during the Promotion Period will provide you with a chance to win the Grand Prize.

You may participate in the Grand Prize Drawing by doing the following:

(a) Joining EAA, renewing your EAA membership, or alternatively, maintaining a valid EAA membership (e.g., Lifetime Members, who will automatically receive one entry for the duration of the Promotion Period); or by …

(b) Participating in EAA’s membership recruitment program. You will receive one (1) entry for each individual who joins EAA during the Promotion Period and identifies you by your EAA membership number as their new Member referral. Lifetime Members may also recruit new Members. (Renewals do not qualify for entries in the recruitment program); or by …

(c) Completing an Entry by Mail, as described below.

To enter by mail, individually mail a 3” x 5” postcard with your full name, EAA Member #, address, and phone number to: EAA’s Membership Promotion 2007, P.O. Box 3086, Oshkosh, WI 54903-3086. Mail entries must be handwritten, and may not be mechanically reproduced, copied, facsimiled, e-mailed or otherwise transmitted electronically. One (1) manual entry per Member, per month will be accepted.

How to Join EAA:

You may renew your existing EAA Membership, join as a new member, or recruit a new Member in any of the following ways:

1. Call 1-800-JOIN-EAA; or
2. Visit our web site at www.eaa.org.

As a condition of being awarded any prize, winners will be required to execute and deliver to EAA a signed affidavit of eligibility; acceptance of these rules; release of liability; and any other documents required to execute transfer of the prize or to pay applicable fees, taxes etc. on the prizes awarded.

Grand Prize Lease

The Grand Prize is a two-year lease on a Diamond DA40 aircraft. The winner will be required to enter into a lease agreement with Diamond Aircraft or Diamond’s designee, but will not be responsible for the standard payments contemplated by normal use of the aircraft. The lease will contain normal usage and other requirements and the winner must be able to meet such requirements and show financial ability to comply with any other lease terms and conditions, including payment of any amounts beyond the payments for normal usage, such as charges, fees, maintenance, penalties, overages, damages, and the like that would be the responsibility of the lessee under the lease.

All entries for the MEMBERSHIP PROMOTION must be received by EAA no later than March 31, 2008. EAA is not responsible for lost, misdirected or late mail. All entries become the property of EAA and will not be acknowledged or returned. EAA reserves the right, at its sole discretion, to cancel, terminate or suspend the MEMBERSHIP PROMOTION in whole or in part should a cause or event beyond EAA’s reasonable control affect the administration, fairness, proper play, or conduct of the MEMBERSHIP PROMOTION. Notice of any such event shall be posted at www.eaa.org. EAA reserves the right to amend and interpret these rules, and all entrants agree to be bound by EAA’s decisions.

BY ENTERING THE MEMBERSHIP PROMOTION, THE WINNER ACKNOWLEDGES THAT EAA HAS NEITHER MADE NOR IS IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, RELATIVE TO THE PRIZE(S) DESCRIBED HEREIN, INCLUDING BUT NOT LIMITED TO, QUALITY, DESIGN, MERCHANTABILITY, MECHANICAL CONDITION, CONSTRUCTION OR FITNESS FOR USE. BY ENTERING THE MEMBERSHIP PROMOTION, YOU RELEASE EAA, THE PARTICIPATING SPONSORS AND ANY OF THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, DIRECTORS, OFFICERS, AND EMPLOYEES FROM ANY LIABILITY WHATSOEVER, AND WAIVE ANY AND ALL CAUSES OF ACTION FOR ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE MEMBERSHIP PROMOTION OR ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE (INCLUDING, WITHOUT LIMITATION, CLAIMS, COSTS, INJURIES, LOSSES AND DAMAGES RELATED TO PERSONAL INJURIES, DEATH, DAMAGE TO OR DESTRUCTION OF PROPERTY, RIGHTS OF PUBLICITY OR PRIVACY, DEFAMATION OR PORTRAYAL IN A FALSE LIGHT, WHETHER INTENTIONAL OR UNINTENTIONAL), WHETHER UNDER A THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY OR OTHER THEORY.

Winners will be notified by mail and/or telephone. If a prize notification letter is returned undeliverable, the prize will be awarded to an alternate winner. Winners will also be announced in EAA Sport Aviation and EAA Sport Pilot & Light-Sport Aircraft magazines, and on www.eaa.org. The odds of winning each drawing will depend upon the number of entries received.

By participating in the MEMBERSHIP PROMOTION, the winner grants permission to EAA and Diamond Aircraft to use and/or reproduce the winner’s name, likeness, and biographical information without compensation for commercial and publicity purposes, including, without limitation, recognition in EAA’s magazines and EAA’s web sites. The MEMBERSHIP PROMOTION is void where prohibited by law. All federal, state and local taxes, fees, withholding, and other expenses (including title fees, permits, registration, shipping, packaging and insurance) are the sole responsibility of the winner. All reasonable efforts shall be used to award the prizes described. If for any reason the prizes are unavailable or undeliverable, EAA reserves the right to substitute an alternative prize of equivalent or greater value. Prizes cannot be assigned, transferred, exchanged, or redeemed for cash.
